Chapter I General Provisions Article 1 This standard is formulated in order to standardize digital printing business activities and promote the healthy development of digital printing. According to the "Regulations on the Administration of Publications", the "Administrative Regulations on Printing Industry" and related laws and regulations, these Measures are formulated.

Article 2 This measure applies to the use of production digital printing presses to engage in publications, printing of packaging, decoration, and other printed matter (hereinafter referred to as digital printing business activities).

The production-type digital printing press referred to in these Measures refers to a digital printing device that has high printing speed, stable printing quality, and can realize industrialized continuous and mass production.

Production digital presses should be equipped with digital workflows; high-speed digital composite machine equipment does not belong to production digital presses.

Article 3 The General Administration of Press and Publication shall be responsible for the supervision and administration of digital printing throughout the country. The local press and publication administrative department at or above the county level shall be responsible for the supervision and administration of digital printing within its administrative area.

The local press and publication administrative department at or above the county level shall strengthen the guidance and supervision of the enterprises engaged in digital printing business operations within its administrative area (hereinafter referred to as digital printing business enterprises), and strengthen the training of digital printing operators in relevant laws and regulations.

Article 4 The State supports and encourages digital printing companies to adopt new technologies, develop new models, and provide new services. Digital printing business enterprises shall establish a quality assurance system, and the quality of printed products shall comply with national and industry standards.

Chapter II Establishment of Enterprises Article 5 The State adopts a licensing system for digital printing business activities; without permission, no unit or individual may engage in digital printing business activities.

Article 6 The establishment of a digital printing enterprise shall meet the following conditions:

(a) The name and the constitution of the company;

(b) have a defined scope of business;

(3) Having a fixed production and business establishment that meets the needs of the business scope, with a building area of ​​not less than 50 square meters;

(4) Having the funds capable of maintaining normal production and operation, the registered capital is not less than 1 million yuan;

(5) There are more than one production-type digital printers;

(6) Organizations and personnel who need to adapt to the scope of business;

(7) Other conditions stipulated by relevant laws and administrative regulations.

The approval of the establishment of a digital printing company shall, in addition to the provisions of the preceding paragraph, also comply with the State's plans for the total number, structure, and layout of printing enterprises.

Article 7 To establish a digital printing enterprise, an application shall be submitted to the local press and publication administrative department at the local level, and the following application documents shall be submitted:

(a) Application. Specify the name and address of the applicant, the name and address of the legal representative or principal person in charge, the source of funds, the amount, the capital composition, and the major issues of the application;

(2) Notice of advance approval of company name and its articles of association;

(3) Certificate of credit issued by the statutory capital verification institution;

(d) Feasibility study report;

(5) certification of business premises and necessary production conditions;

(6) The identity certificate and biographical record of the legal representative or principal responsible person.

Article 8 The provincial press and publication administrative department shall, within 20 days from the date of acceptance of the application, make a decision of approval or disapproval and notify the applicant. If the establishment of an application is approved, the provincial press and publication administrative department shall issue a “printing business license”, and the column of business scope shall indicate “printing of publications, packaging and decoration printed matter and other printed matter by digital printing”; if it is not approved, it shall indicate reason.

The provincial press and publication administrative department shall, within 20 days from the date of issuing the "printing business license," submit the copy of the approval document and the "printing business license" (original and duplicate) to the Press and Publication Administration for the record.

Article 9 Digital printing business activities may take the form of chain operations.

The digital printing chain operating companies carry out digital printing business operations under the unified management of the chain operation headquarters (hereinafter referred to as chain headquarters) and implement standardized management.

In addition to the provisions of Article 6 of these Measures, a digital printing chain operation enterprise shall also comply with the management requirements for chain operations such as direct chain operations and franchised chain operations. Enterprises engaged in digital printing chain business activities shall be composed of more than 5 chain stores, and the registered capital of the chain headquarters shall be no less than RMB 5 million.

Article 10 In order to establish a digital printing chain operation enterprise, the headquarters of the chain shall submit the application materials stipulated in Article 7 of the present Measures to the local press and publication administrative department at the local level, as well as the list of business premises of the chain headquarters and chain stores, and the operation plan. After obtaining permission from the chain headquarters, each chain store holds the “printing business license” (copy) of the chain headquarters and the application materials of the headquarters to the local provincial press and publication administrative department for the record, and obtains the “printing business license” (positive, copy). The column of business scope indicates “printing of publications, packaging and decoration prints, and other printed materials in a digital print chain operation”.

Article 11 In establishing a foreign-funded digital printing enterprise, in addition to complying with the provisions of these Measures, the investment proportions and rights of Chinese and foreign parties shall also comply with the Provisional Regulations on the Establishment of Printing Enterprises with Foreign Investment and the relevant provisions of the supplementary provisions.

Article 12 Existing enterprises engaged in the printing and printing of publications, packaging and decoration products or other printed matters shall carry out digital printing business activities within the scope of their original approved business operations, and shall be exempt from the digital printing approval procedures.

Any enterprise engaged in the printing, publication and printing of packaging, decoration, and other printed matters or any other printed matter that exceeds the scope of business it originally approved to carry out digital printing business activities shall go to the provincial-level press and publication administration according to the provisions of Articles 6 to 8 of these Measures. Departments apply for digital printing approval procedures.

Chapter III Management of Operational Activities Article 13 Digital printing operators must strictly abide by relevant laws and regulations of the State and accept the daily supervision and administration of the local press and publication administrative department. The legal representative or principal person in charge of a digital printing business enterprise shall regularly receive business training organized by the press and publication administrative department, and obtain the "Qualification Certificate for Printing Law Training" issued by the provincial press and publication administrative department.

Article 14 A digital printing business enterprise shall establish and improve systems such as printing entrustment, printing verification, printing of printing, storage of printed matter, delivery of printed materials, and destruction of defective products in printing activities.

Article 15 A digital printing business enterprise shall hang a "printing business license" in a conspicuous place on its business premises.

Those who engage in printing business activities through the Internet shall publicize the "printing business license" on the front page of the website.

Article 16 A digital printing business enterprise that accepts entrusted printing of a publication shall verify the printed power of attorney and other statutory instruments in accordance with the relevant provisions of the Printing Industry Management Regulations.

Article 17 A digital printing business enterprise that accepts entrusted printing of printed and decorating printed matter and other printed matter shall go through relevant procedures in accordance with the "Regulations on Printing Industry Administration."

Article 18 A digital printing chain management company establishes a standardized and unified business management system, and accepts commissioned printing of publications under the unified organization of the chain headquarters. The authorized chain headquarters or chain stores verify and retain the relevant printing power of attorney. Samples of publications that have been commissioned for printing are available for reference, and other chain stores are exempted from handling the relevant procedures.

Chapter IV Legal Liabilities Article 19 Those who engage in digital printing business activities without approval shall be banned by the public security department and the administrative department for industry and commerce on the basis of statutory powers and functions.

Article 20 If a digital printing business enterprise violates relevant provisions, it shall be given an administrative penalty in accordance with the "Regulations on the Administration of Printing Industry". If the circumstances are serious, the original license issuing authority shall revoke the license; if a crime is constituted, criminal responsibility shall be investigated according to law.

Article 21 The chain headquarters of a digital printing chain operation enterprise shall strengthen the management of daily operations of chain stores.

Where a chain store is subject to administrative fines (including fines) imposed by the press and publication administrative department, the administrative penalty enforcement unit shall file the punishment result with the provincial press and publication administrative department where the headquarters of the chain is located.

Where a chain store accumulatively receives an administrative penalty of more than two fines (including fines) within one year, the chain headquarters shall abolish the chain store or terminate the chain business relationship with the chain store, and shall, in accordance with the "Printing Industry Management Regulations," violate the law, "The circumstances are serious. In accordance with relevant regulations, the original issuing authority revoked the "printing business license" of the chain store.

If more than one-third of the chain stores are fined (including fines) or more than an administrative penalty within one year, the provincial press and publication administrative department shall order the chain headquarters to rectify; if the rectification does not pass, the “illegal behavior of the printing industry management regulations” For serious "related regulations, the original issuing authority shall revoke the "printing business license" of the chain headquarters and all chain stores.

Article 22 An enterprise that has engaged in digital printing business activities before the implementation of these Measures shall go to the provincial press and publication administrative department within 180 days from the date of implementation of the present Measures to handle the relevant formalities in accordance with these Measures.

Article 23 The present Measures shall come into force on February 1, 2011.
